1. Architectural & Planning Services Policy

Regulatory Compliance

All designs and plans are prepared in accordance with the National Building Regulations and Building Standards Act (Act 103 of 1977) and all applicable Gauteng municipal by-laws.

Submission Protocols

While we diligently manage and follow up on all building plan and town planning submissions, municipal approval timeframes remain solely dependent on the relevant municipal authority.

Intellectual Property

All architectural drawings, concepts, plans, specifications, and digital models remain the intellectual property of Melanie Prior Industries and Trading until full and final payment has been received.

2. Construction & Site Operations Policy

Safety Standards

Construction activities are conducted in compliance with the Occupational Health and Safety Act (OHSA, Act 85 of 1993) and all applicable Construction Regulations of South Africa.

Variations & Deviations

Any requested changes to approved building plans or project scope must be documented through a formal Variation Order (VO) and signed by both parties before additional work commences.

Site Access

Clients are responsible for ensuring safe, legal, and unrestricted access to the project site for personnel, machinery, and material deliveries during agreed working hours.

3. Import & Export Operations Policy

Customs & Licensing

All import and export activities are conducted under valid South African Revenue Service (SARS) importer/exporter registrations and comply with International Trade Administration Commission (ITAC) regulations.

Incoterms Compliance

International trade transactions are governed by the applicable Incoterms® 2020 rules specified within each individual agreement.

Tariff & Duty Responsibility

Unless otherwise agreed in writing, the buyer remains responsible for all destination customs duties, taxes, port charges, and import clearance costs.

Documentation Standards

Standard shipping documentation including Commercial Invoices, Bills of Lading/Air Waybills, Packing Lists, and Certificates of Origin will be supplied where applicable.

4. Metals & Chemicals Trading Policy

Hazardous Materials

The handling, storage, transportation, and distribution of chemicals comply with the National Environmental Management Act (NEMA) and relevant South African National Standards (SANS).

Quality Assurance

Where applicable, shipments include Material Safety Data Sheets (MSDS) and Certificates of Analysis (CoA) to verify product quality and specification.

Demurrage & Detention

Any storage charges, container detention, or demurrage resulting from delays in client clearance shall be for the client's account.

5. General Commercial Terms & Conditions

Payment Milestones

Professional services and construction projects follow an agreed milestone-based payment schedule, including deposits and progress payments where applicable.

Trade Financing

International trade transactions may require approved financing structures, including confirmed irrevocable Letters of Credit (L/C), Telegraphic Transfers (T/T), or approved trade credit facilities.

Jurisdiction

These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes shall fall under the jurisdiction of the Gauteng Local Division of the High Court.
